Age Restrictions for Children on Social Media: A Necessary but Insufficient Reaction

The OECD reports that 25 economies have or are considering social media age restrictions. What this trend means for children's online safety and a country like Romania.

In recent years, the discussion about protecting children online has shifted from general recommendations to concrete legislative measures. More and more states are analyzing or adopting age restrictions for children's access to social media platforms, and this phenomenon can no longer be treated as an isolated initiative. According to the OECD, as of April 2026, 25 OECD member or candidate economies had age restrictions for social media already in effect, adopted, or under review, compared to just one at the end of 2023.

This acceleration shows a major shift in perspective: societies are beginning to accept that children's exposure to social media is not just a matter of individual choice or parental responsibility, but also an issue of public health, digital safety, data protection, and tech governance.

Why Age Restrictions Are Increasing

Social media can offer real benefits for children and adolescents: communication, creativity, access to communities, personal expression, and informal learning. The problem arises when these benefits are delivered through platforms built around attention capture, behavioral profiling, algorithmic recommendations, and the monetization of interaction.

The OECD emphasizes that the problematic use of social media, characterized by excessive preoccupation, escapism, and conflict, is on the rise and particularly affects girls. At the same time, legislative pressure reflects a growing recognition that many platforms were not designed with children's safety and well-being in mind and have not effectively enforced their own minimum age limits.

Here lies one of the great contradictions of the current digital environment: many platforms state age limits, but in practice, these have been easy to bypass. A child could enter a false date of birth, and the platform could formally consider its obligation fulfilled. From the perspective of protecting minors, this model is no longer sufficient.

Why 15 or 16 is Becoming the New Benchmark

An important element noted by the OECD is the international convergence around the 15–16 year threshold. Although states have different legal traditions and regulatory cultures, most of the proposals and laws analyzed focus on these ages. Australia, which was one of the first to act and set the threshold at 16, seems to have influenced the international debate. The OECD mentions that all laws adopted up to that point use the age of 16 as the minimum threshold for social media access.

This trend doesn't mean that the age of 16 is a perfect solution. Rather, it represents a political and social compromise between child protection, adolescent autonomy, and the technical difficulty of enforcing restrictions. Lower thresholds, such as 13 or 14, have been discussed in some jurisdictions, but the dominant direction seems to be shifting responsibility towards stronger protection during early adolescence.

Age Restrictions Alone Do Not Solve the Problem

The most important idea from the OECD analysis is that age restrictions are not a silver bullet. Online risks cannot be reduced solely by controlling access. Children can be exposed to harmful content, manipulation, harassment, exploitation, fraud, radicalization, disinformation, contact with malicious individuals, or social pressures even in environments that formally seem age-appropriate. The OECD warns that existing age verification policies and practices still have significant legal, jurisdictional, and practical gaps.

Therefore, the real question is not just 'from what age can a child have an account?' but 'what should a safe platform for a child or adolescent look like?'. The difference is crucial.

A safe platform for minors should not rely solely on bans. It should include 'safety by design' principles: default privacy settings, limited profiling, reduction of addictive mechanisms, transparent parental controls, effective reporting, adequate moderation, limiting contact with strangers, reducing aggressive recommendations, and prohibiting manipulative practices like dark patterns.

Age Verification: Protection or a New Risk?

Any age restriction raises a sensitive technical and legal issue: how do you verify a user's age without creating greater risks to privacy, security, and freedom of expression?

The OECD warns that poorly designed age assurance mechanisms can collect more data than necessary, increase exposure to security breaches, and exclude users who do not have formal identity documents.

This is a critical observation. Protecting children must not become a pretext for excessive data collection. An age verification solution that forces users to upload identity documents, facial images, or other sensitive data to commercial platforms can create a systemic risk. Instead of protecting children, we could be building databases that are extremely valuable to attackers, data brokers, or entities seeking to profile users.

For this reason, future policies must adhere to several clear principles: data minimization, verification proportional to the risk, local storage of information where possible, independent audits, transparency, and the separation of age verification from commercial profiling.

The Risk of Fragmented Regulation

Another major problem identified by the OECD is the lack of international coordination. If each state independently defines the minimum age, verification methods, platform obligations, and penalty mechanisms, the result could be a legislative patchwork that is difficult to enforce. Global platforms will have to comply with different rules from one jurisdiction to another, and children will receive unequal levels of protection depending on the country they live in.

For the European Union, and by extension for Romania, this discussion must be connected to data protection, online safety, digital education, and platform accountability. A coherent approach cannot be built exclusively through bans. It must include regulation, education, technological responsibility, and parental involvement.

What This Means for Romania

For Romania, the debate is highly relevant. Children are using social media from increasingly younger ages, and parents, schools, and authorities often find themselves in a reactive position. We intervene after incidents occur: online harassment, exposure to inappropriate content, scams, blackmail, deepfakes, identity theft, compromised accounts, or manipulation through viral content.

A potential national discussion on age restrictions should avoid two extremes. The first is the idea that everything can be solved with a ban. The second is the idea that responsibility lies exclusively with parents and children. Both are incomplete.

A multi-level approach is needed:

  • Real digital education, introduced early and adapted to the child's age. Children need to understand what personal data, profiling, algorithms, manipulation, fake accounts, fraud, and online social pressure mean.
  • Platform accountability, not just user accountability. Platforms must be required to demonstrate that their products are safe for minors, not just transfer the risk to parents through hard-to-read terms and conditions.
  • Smart parental controls, not excessive surveillance. Parents need clear, configurable, and transparent tools, not invasive solutions that destroy trust between child and adult.
  • Protection of children's data, as a central principle. Any age verification mechanism must be proportional, secure, and collect as little data as possible.
  • Cooperation between authorities, including those in education, child protection, data protection, cybersecurity, and consumer protection.

A Child Should Not be Treated as a Simple User

One of the fundamental errors of the digital economy is treating a child as an ordinary user, just younger. In reality, a child is a person undergoing cognitive, emotional, and social development. They need extra protection, explanations, appropriate digital spaces, and adults capable of understanding the risks.

Social media is not just a communication space. It is an algorithmic environment that influences attention, behavior, self-image, social relationships, and the perception of reality. For children, this influence can have more profound effects than for adults.

That is why age restrictions should be seen as a wake-up call, not a final destination. They show that the current self-regulation model of platforms is no longer considered sufficient.

What Comes Next

The OECD emphasizes that the coming years will be critical. As more laws come into effect, concrete data on their effectiveness will emerge. Governments will have to decide not only what minimum age to set, but also how to define compliance, how to verify the enforcement of rules, how to protect user data, and how to avoid unwanted side effects.

For Romania, the time is right for a serious debate, based on data and the reality of digital use by children. We don't need moral panic, but we don't need passivity either. We need a coherent framework in which the child is protected, the parent is supported, the school is involved, and platforms are held accountable.

Conclusion

Age restrictions for social media are a natural reaction to the increasingly obvious risks of the digital environment. However, they cannot work in isolation. A ban without education, verification without data protection, and regulation without coordination can produce limited effects or even create new risks.

Protecting children online must start from a simple idea: the digital environment is no longer optional in their lives, but it should not be accepted in its current form, dominated by attention capture, profiling, and algorithmic exposure.

The real challenge is not just to keep children off platforms until a certain age. The challenge is to build a digital ecosystem where children can learn, communicate, and develop without being turned into commercial, behavioral, or criminal targets.
